1. Acceptance of Terms

By accessing or using the CopeMeds website, mobile application, or counselling services (collectively, “Services”), you (“User,” “you,” “your”) confirm that you have read, understood, accept and consent voluntarily to be bound by these Terms & Conditions (“Terms”). If you disagree with any part or in total  to the Terms, you must not use the Services. The following Terms and Conditions constitute a legal agreement between CopeMeds and its users

2. AGE

Users aged 18 years or older may create an account and use CopeMeds Services independently, including access to the PreMeds Module. CopeMeds does not knowingly provide Services to anyone under 18 years of age; such individuals should not attempt to register. All users must keep passwords and account details confidential and notify CopeMeds immediately of any unauthorised use.

 3. Mission & Purpose

CopeMeds exists to nurture the mental health and promote mental health wellness, resilience, and coping capacity of medical students, healthcare trainees, and professionals through evidence-based stress-management frameworks, peer-support resources, and educational content. These Services complement—but do not replace—professional medical or psychological care.

4. Nature of Services & Medical Disclaimer

Informational and supportive only. CopeMeds offers mental-health education, peer-support frameworks, and counselling sessions more as a preventive rather curative measure. These programs/sessions  are not a substitute for professional counselling or therapies or diagnosis or treatment  delivered by licensed/professional psychologist or psychiatrist

5. Not a substitute for medical care

The Services do not constitute or offer medical diagnosis, treatment, psychotherapy, or emergency care. Professional Counselling as part of treatment/ therapy/diagnosis of mental/physical illeness are not under the scope of services of Cope Meds and users requiring these services should not use our services and are advised to seek appropriate professional help

6. Intellectual Property & Limited Personal-Use Licence

Unless otherwise stated, the intellectual property rights in the website and its material including logos, brand, signature, content  etc are owned by CopeMeds. All these intellectual property rights are reserved, subject to the license below

  • You may view, download, and print pages for personal, non-commercial use only.
  • You may not publish, sell, rent, sub-license, reproduce, duplicate, copy, redistribute, or otherwise exploit any IP for commercial purposes without prior written consent from an authorised CopeMeds signatory.
  • Unauthorised use may lead to termination and legal action.
7. Acceptable Use & Restricted Access

You may not:

  • Damage, disable, or impair the website or its accessibility;
  • Upload, transmit, or distribute malware, spyware, Trojan horses, worms, keystroke loggers, rootkits, or other malicious code;
  • Overload (“flood”), “mail-bomb,” crash, or otherwise interfere with any network or user;
  • Send unsolicited or commercial emails without permission;
  • Use the Services for unlawful, defamatory, fraudulent, obscene, or harmful purposes;
  • Copy, store, host, or distribute harmful content or commercial spam.

CopeMeds may restrict or revoke access to any area of the website at its sole discretion.

8. No Warranty & No Guarantee

The Services are provided “as is” without express or implied warranties. CopeMeds makes no representations on accuracy, completeness, or outcomes. Results depend on individual participation and implementation; no specific outcome or benefit is guaranteed.

9. Third-Party Links, Blogs & Educational Content

Links to third-party sites or materials are provided for convenience. CopeMeds is not responsible for their content, accuracy, or availability, and accepts no liability for losses/damages arising from their use. Blog posts reflect authors’ opinions; users should exercise discretion and verify information independently

10. Privacy & Confidentiality

Personal data provided will be processed by copemeds for the conditions of use only and confidentiality will be maintained. Session details and personal records are confidential except when disclosure is (i) legally mandated or (ii) necessary to prevent imminent harm to self/others. CopeMeds does not store card details and shares personal data only as required by law.

11. Fees, Payments, Refunds & Cancellations
  • Payment Policy: Applicable fees will be communicated on enquiry. Full payment for the entire program is due 48 hours before the first session; bookings lapse if unpaid.
  • Session Duration: 45–60 minutes. Sessions cannot be extended for late arrival. Arrival ≥ 20 minutes late counts as a no-show.
  • Refund Policy: All sales are final. No refunds except as stated below.
  • User Cancellation: Cancel or reschedule ≥ 24 hours before the commencement of first session for a full refund. No refund for later cancellations or no-shows.
  • Faculty Cancellation: If CopeMeds must cancel, you may (a) reschedule or (b) obtain a 100 % refund.
  • Over-run Fees: Sessions exceeding 15 minutes beyond the booked slot may incur additional fees.
12. Termination Policy
  • Users may terminate participation at any time; However no refund will be provided.Faculty may terminate a programme if they feel unsafe; Partial refund will be allowed if faculty cancels the program

Indemnity

  • As a condition of your use of this website and our services the user unilaterally agrees to  indemnify and hold harmless CopeMeds, its officers, directors, employees, and affiliates from any losses, damages, costs, or expenses (including legal fees and amounts paid to a third party in settlement of a claim or dispute) arising from your use of the Services or breach of these Terms.
13. Limitation of Liability

To the fullest extent permitted by law, CopeMeds shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, even if advised of the possibility )arising out of use or inability to view/use materials/content. Total liability will not exceed amounts you have paid to CopeMeds, if any, relating to the cause of action. By using this website, you agree that the exclusions and limitations of liability outlined in this website disclaimer are reasonable. If you don’t agree, please don’t use this website or our services

14. Variation / Modification
  • CopeMeds may revise these Terms at any time. Updated Terms become effective upon posting with a revised “Last updated” date. Continued use after changes constitutes acceptance.
15. Assignment
  • CopeMeds may transfer or subcontract its rights and obligations without notice. Users may not transfer their rights or obligations without prior written consent.
16. Severability

If any provision of these Terms is held unlawful or unenforceable, the remaining provisions remain in force. Where possible, the unenforceable provision shall be modified to reflect the parties’ intent

17. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.

18. APPLICABILITY

These terms and conditions constitute the entire agreement between you and CopeMeds with regard to your use of this website and replace all prior agreements
